Terms of Service for Retslav

Welcome to Retslav! These Terms of Service ("Terms") govern your use of our services, including free gameservers, paid gameservers, dedicated servers, and our development environment. By accessing, registering for, or using any of our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By creating an account or using our services, you acknowledge that you have read, understood, and agreed to these Terms, as well as our Privacy Policy and Acceptable Use Policy. These documents form the entire agreement between you and Retslav. We may modify these Terms at any time; changes are effective upon posting. Continued use after changes constitutes acceptance.

2. Description of Services

• Free Gameservers: Basic hosting with limited resources for personal or small-scale use.
• Paid Gameservers: Enhanced plans with higher resource limits, configurability, and priority support.
• Dedicated Servers: Full bare-metal or virtualized servers for high-performance workloads.
• Development Environment: Online workspace for building, testing, and hosting code (collaborative features may be limited during beta).

Services are provided on an "as-is" basis. We strive for high availability but do not guarantee uninterrupted uptime.

3. Eligibility & Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) to register. You agree to provide accurate and current information. You are responsible for safeguarding credentials (including API keys) and all activity under your account. Notify us promptly of any unauthorized access.

4. Payment & Billing

• Billing Cycle: Subscriptions and recurring services are billed in advance unless otherwise stated.
• Payment Methods: Processed by third-party providers (e.g., Stripe). We do not store full payment details.
• Taxes: You are responsible for applicable taxes. Displayed prices may exclude VAT unless marked as inclusive.
• Refunds: Limited refunds may be granted within 14 days for qualifying purchases. Custom configurations or provisioned dedicated hardware are generally non-refundable.
• Disputes: Contact support for billing disputes; we will review and respond in good faith.

5. Delivery & Customer Obligations

• Provisioning: Paid services typically activate within 24 hours after payment confirmation. Free services provision instantly, subject to capacity.
• Maintenance: Scheduled maintenance may cause temporary interruptions; we will provide notice when feasible.
• Backups: Unless explicitly included, you are responsible for backing up your data. We are not liable for data loss.
• Configuration: Misconfiguration causing instability, abuse, or excessive resource use may result in suspension until resolved.

6. Intellectual Property

Our platform, branding, and software are protected by intellectual property laws. You retain ownership of content you deploy but grant us a non-exclusive license to host, process, and transmit it as needed to provide services.

7. Prohibited Use & Acceptable Use

You must comply with our Acceptable Use Policy. Prohibited activities include (without limitation): illegal content, network abuse (DDoS, scanning), malware distribution, credential harvesting, and excessive resource consumption that degrades platform stability.

8. Limitation of Liability

To the maximum extent permitted by law, Retslav is not liable for indirect, incidental, special, or consequential damages (including lost profits or data). Our aggregate liability for any claim related to a service is limited to the fees you paid for that service in the preceding 12 months. We are not responsible for third‑party failures or force majeure events.

9. Termination & Suspension

• By You: You may terminate your account via the portal or by contacting support.
• By Us: We may suspend or terminate services for violations, non‑payment, security risk, or platform integrity concerns.
• Post‑Termination: Access ceases immediately. Data may be deleted after a grace period (typically 30 days) unless legal obligations require retention.

10. Indemnification

You agree to indemnify and hold Retslav harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of services, violation of these Terms, or infringement of third‑party rights.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands. Disputes will be resolved in the competent courts of the Netherlands unless mandatory local consumer protection rules apply. We may explore informal resolution before formal proceedings.

12. Miscellaneous

• Severability: If any provision is unenforceable, the remainder remains in effect.
• Entire Agreement: These Terms, the Privacy Policy, and the Acceptable Use Policy form the entire agreement.
• No Waiver: Failure to enforce a provision does not waive our right to enforce it later.
• Assignment: You may not assign your rights without prior written consent.
